Medical Disclaimer: Vial Tracker is a personal wellness tracking tool for informational and organizational purposes only. It is not a medical device, does not provide medical advice, and is not a substitute for professional medical care. Always consult a qualified healthcare provider before starting, stopping, or modifying any medication, supplement, or injection protocol.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and VIAL TRACKER ("Company," "we," "us," or "our") governing your use of the Vial Tracker mobile application ("App").

By downloading, installing, or using the App, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, do not use the App.

2. Description of Service

Vial Tracker is a mobile application that allows users to:

• Track injection-based protocols including GLP-1 medications, peptides, hormones, and other compounds
• Log doses, injection sites, and schedules
• Monitor body weight and track progress over time
• Log symptoms and side effects
• Access an educational compound library for informational purposes
• Use an AI-powered wellness coach for general protocol guidance
• Upload and analyze bloodwork results using AI
• Receive dose reminders via push notifications

3. Medical Disclaimer and Limitation of Use

Important — Please Read Carefully

Vial Tracker is an organizational and informational tool only. Nothing in the App, including but not limited to the compound library, AI Coach responses, Bloodwork AI analysis, or any other feature, constitutes medical advice, diagnosis, or treatment.

• The App does not replace professional medical advice from a licensed healthcare provider
• The compound library is provided for educational and informational purposes only
• The AI Coach is an AI-powered informational tool and is not a licensed medical professional
• Bloodwork analysis provided by the App is for general informational purposes only and should not be used to make medical decisions
• Always consult a qualified healthcare provider before beginning any injection protocol, changing your dosage, or making any health-related decisions
• VIAL TRACKER is not responsible for any health outcomes resulting from use of information within the App

4. Eligibility

To use Vial Tracker you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable law
• Reside in a jurisdiction where the App is available

By using the App you represent and warrant that you meet all eligibility requirements.

5. Account Registration

Vial Tracker uses Sign in with Apple for account creation and authentication. By creating an account you agree to:

• Provide accurate and truthful information
• Maintain the security of your Apple ID credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions and Payments

6.1 Free and Paid Plans

Vial Tracker may offer both free and paid subscription tiers. Features available on each tier are described within the App and may change over time.

6.2 Billing

All payments are processed by Apple through the App Store. By subscribing to a paid plan you agree to Apple's payment terms. We do not directly handle, store, or process your payment information.

6.3 Subscription Renewal

Paid subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Apple ID settings.

6.4 Refunds

All refund requests are handled by Apple in accordance with their App Store refund policy. We do not issue refunds directly.

7. Acceptable Use

You agree to use Vial Tracker only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the App or its related systems
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Upload any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Use the App to transmit any unsolicited or unauthorized advertising or promotional material
• Interfere with or disrupt the integrity or performance of the App
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Use the App in any manner that could damage, disable, overburden, or impair our servers

8. Intellectual Property

The App and all its content, features, and functionality — including but not limited to the VIAL TRACKER name and logo, text, graphics, compound library content, interface design, and code — are owned by VIAL TRACKER and are protected by United States and international intellectual property laws.

The VIAL TRACKER trademark is pending registration with the United States Patent and Trademark Office under Application Serial Number filed May 12, 2026.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the App without our express written permission.

9. User Content

You retain ownership of all data you input into Vial Tracker including your protocol logs, weight entries, symptom logs, and bloodwork uploads. By using the App you grant VIAL TRACKER a limited license to store, process, and display your content solely for the purpose of providing the App's services to you.

You represent and warrant that you have the right to submit any content you input into the App and that such content does not violate the rights of any third party.

10. AI Features — Important Limitations

10.1 AI Coach

The AI Coach feature uses artificial intelligence to respond to questions about protocols, compounds, and wellness topics. You acknowledge that:

• AI Coach responses are generated by an AI model and may contain errors or inaccuracies
• AI Coach is not a licensed medical professional and its responses do not constitute medical advice
• You should not make medical decisions based solely on AI Coach responses
• All AI Coach responses are for informational and educational purposes only

10.2 Bloodwork AI

The Bloodwork AI feature analyzes uploaded lab results using artificial intelligence. You acknowledge that:

• Bloodwork AI analysis is for informational purposes only and is not a medical interpretation
• Results may not be accurate or complete
• You should always have your bloodwork reviewed by a licensed healthcare provider
• VIAL TRACKER is not liable for any decisions made based on Bloodwork AI analysis

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, VIAL TRACKER DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the App.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIAL TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, PERSONAL INJURY, OR ANY OTHER DAMAGES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless VIAL TRACKER and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Upon termination your right to use the App will immediately cease. You may also terminate your account at any time by contacting us at leo@vialtracker.app and requesting account deletion.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bergen County, New Jersey.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes we will notify you through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms together with our Privacy Policy constitute the entire agreement between you and VIAL TRACKER regarding your use of the App and supersede all prior agreements and understandings.
